Terms of Use
Last Updated: October 6, 2025
These Terms of Use govern access to and use of our website, mobile apps, and services. By using the Services, you accept these Terms.
Effective Date: October 10, 2025
Last Updated: October 6, 2025
1. Who we are and how these terms work
CareerOwl Ltd. provides an online job marketplace and related services for job seekers and employers. “CareerOwl,” “we,” “us,” and “our” mean CareerOwl Ltd.
Registered office: 735 Maple Drive, Quesnel, British Columbia, Canada, V2J 5M9.
Contact: legal@thecareerowl.ca
These Terms of Use govern access to and use of our website, mobile apps, and services (the “Site” or “Services”). By using the Services, you accept these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Services.
We may update these Terms. Changes take effect when posted. If a change materially affects your rights, we will try to give extra notice (email or in-product message).
2. Key definitions
- account: your registered profile as a job seeker or employer.
- job seeker: a person who browses, creates a profile, uploads a resume, or applies to jobs.
- employer: a business or recruiting agency that posts jobs or uses hiring tools.
- content: anything posted or uploaded, including resumes, job ads, messages, reviews, images, video, and code.
- integrations: third-party tools connected to the Services (e.g., ATS, analytics, background screening, video interview, optimization tools).
- applicable laws: includes Canadian federal and BC law, and any laws that apply to you based on where you operate.
3. Eligibility, accounts, security
You must be legally capable of entering a contract in your jurisdiction. If you create an account:
- provide accurate, current information;
- keep your credentials confidential;
- you are responsible for all activity on your account.
We may suspend or terminate accounts for policy violations, unlawful use, security risks, or inactivity.
4. What CareerOwl is (and is not)
CareerOwl is a platform. We are not an employer of job seekers using the Site. We do not guarantee a job, candidates, or any hiring outcome. Employers are solely responsible for their job ads, screening questions, interview decisions, compensation disclosures, and compliance with labour, privacy, human rights, and anti-discrimination laws in their jurisdiction. This model reflects standard practice on large job boards.
5. Acceptable use and prohibited conduct
Use the Services lawfully. Do not:
- post unlawful, defamatory, harassing, hateful, misleading, or deceptive content;
- discriminate or post discriminatory ads;
- collect personal data without a lawful basis and notice;
- upload malware or attempt to breach security;
- scrape, spider, harvest, or crawl the Site without written permission;
- reverse-engineer or circumvent technical protections;
- misrepresent identity, affiliation, or authorization;
- interfere with Site operation, analytics, or ad measurement;
- resell, sublicense, or frame the Services.
We may rate-limit, block, or remove content, and suspend or terminate accounts to protect the platform and users.
6. Job seeker services
You may create a profile, upload a resume, set visibility controls, search jobs, receive recommendations, and apply. If you opt into a searchable profile, employers may view your profile; if you keep it hidden, only employers you apply to can view it.
You are responsible for the accuracy of your resume and applications. You decide what to disclose. Do not include sensitive data unless truly necessary (e.g., health or union data).
7. Employer services
Employers may create company profiles, post jobs, view applications, use search and messaging tools, and purchase paid features. Employers must:
- comply with all employment standards, human rights, accessibility, pay-transparency, and privacy laws;
- ensure ads are accurate, lawful, and non-discriminatory;
- honour accommodations and accessibility requirements;
- keep candidate data secure, use it only for hiring, and delete it when no longer needed;
- comply with Canada’s CASL when sending commercial messages.
Employers are responsible for any screening questions, criteria, salary ranges, and benefits disclosures. Platforms like Indeed similarly place responsibility on employers for job ad compliance and content.
8. Third-party integrations and ATS flows
You may connect third-party tools (ATS, analytics, background checks, video interview, resume optimization, social sign-in). When you connect a tool, you authorize CareerOwl to exchange data with that tool. Those providers process data under their own terms and policies. If an employer requires you to complete steps on an external ATS or site, that process is controlled by the employer and/or the ATS provider.
Similar job platforms make clear that employer ATS flows and employer content are not controlled by the job board; CareerOwl follows that approach.
9. Paid products, fees, billing, and renewals
Pricing, features, and renewal terms are shown at purchase. By buying, you agree to:
- pay all fees, taxes, and currency charges;
- recurring subscriptions renew automatically until you cancel (unless stated otherwise);
- you can cancel future renewals in your account or by contacting billing;
- partial-period refunds are not guaranteed unless required by law or our posted refund policy.
For usage-based ads (e.g., pay-per-click or sponsored jobs), charges are based on our measurements (impressions, clicks, applies) as recorded by our systems. Metrics may vary across platforms; we do not guarantee a particular reach, click-through, conversion, or hire.
10. Advertising and sponsored jobs
If you purchase sponsored placement or targeted distribution:
- placement, ranking, and reach depend on multiple factors (bid, relevance, quality, location, demand, user preferences, and fraud prevention);
- we may filter invalid or fraudulent activity and adjust billing;
- we may display “sponsored” or similar labels where required;
- we do not guarantee a specific position, number of views, or applications.
11. Messaging, notifications, and CASL consent
You may receive service messages, application updates, interview requests, and marketing (if you consented). You can opt out of marketing at any time. For SMS features, carrier charges may apply; we are not liable for delays or failures beyond our control.
12. Content: your license to us; our license to you
Your content remains yours. You grant CareerOwl a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, transmit, display, and distribute your content to provide and improve the Services and to comply with law. You also grant us the right to create de-identified and aggregated data from your content.
We grant you a limited, revocable, non-transferable license to access and use the Services for their intended purpose, and to download and print one copy of Site materials for personal or internal business use. This limited use mirrors the typical “view, download, print one copy” authorization used by major job boards.
13. Content rules and moderation
We may remove or decline content that violates these Terms or the law. We do not undertake to screen everything. We are not responsible for user-provided content, employer messages, or external links. (Other large job sites take the same position: employers control their questions and criteria.)
14. No legal, employment, or immigration advice
We provide a platform, not professional advice. Decisions about hiring, employment eligibility, sponsorship, immigration, and compliance belong to employers and job seekers. Get your own advice as needed.
15. Screening tools and background checks
If an employer uses screening or background checks (including through an integration), the employer is the controller of that process and must follow applicable law (e.g., consent, fair-hiring, FCRA in the U.S., privacy and human rights in Canada). CareerOwl is not a background screening agency and does not make hiring decisions.
16. Data; privacy; cookies
Our Privacy Policy explains how we collect and use personal information and how to exercise your rights. Our Cookie Policy explains tracking technologies and your choices. By using the Services, you consent to our data practices as described there.
17. Security and reporting vulnerabilities
We use reasonable administrative, technical, and physical safeguards. No system is perfect. If you discover a vulnerability or breach, contact security@thecareerowl.ca. Do not publicly disclose security issues before we address them.
18. Intellectual property; DMCA/trademark notices
CareerOwl content (text, graphics, logos, software, and design) is protected by copyright and trademark law. Do not copy, modify, or exploit it except as allowed in section 12.
If you believe content infringes your IP:
- send a notice to legal@thecareerowl.ca with your contact details, the work claimed to be infringed, the location of the material, and a statement under penalty of perjury that you own or are authorized to act;
- for copyright claims involving U.S. materials, you may submit a DMCA-style notice;
- for repeat infringement, we may suspend or terminate accounts.
19. API and developer use
You must have written permission to use any CareerOwl API. API access is rate-limited, revocable, and subject to separate API terms. Do not scrape the Site or bypass the API.
20. Mobile apps; app-store terms
If you install our app, your use also follows the app-store terms (Apple App Store, Google Play). Those stores are not responsible for support, maintenance, or legal claims about the app. You must use the app on devices you own or control and as permitted by the store rules.
21. Beta features and tests
We may test features or release beta tools. Beta features are provided “as is,” may be withdrawn, and may be subject to additional terms.
22. Export controls and sanctions
Do not use the Services in violation of Canadian export controls or applicable sanctions laws. You confirm you are not on a restricted list.
23. Disclaimers
The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a purpose, and non-infringement. We do not promise uninterrupted availability, that ads will meet performance targets, or that any job or candidate will be suitable.
24. Limitation of liability
To the maximum extent allowed by law:
- we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages;
- our total liability for any claim is limited to the greater of CAD 100 or the amount you paid to us for the Services giving rise to the claim in the 12 months before the event.
Some jurisdictions do not allow certain exclusions or limits; those limits apply to the fullest extent permitted.
25. Indemnity
You will defend, indemnify, and hold harmless CareerOwl and our directors, officers, employees, and agents from any claim, loss, liability, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your content; (b) your use of the Services; (c) your breach of these Terms; or (d) your violation of law or third-party rights.
26. Term; termination; suspension
These Terms apply while you use the Services. We may suspend or terminate accounts or features at any time for any reason, including inactivity or risk to the platform. You may delete your account at any time. Sections that reasonably should survive (licenses, payments owed, disclaimers, limits, indemnities, governing law) will survive.
27. Governing law; venue
These Terms are governed by the laws of Canada and the Province of British Columbia, without regard to conflicts rules. Courts in British Columbia have exclusive jurisdiction, except where mandatory local law provides otherwise.
28. For users outside Canada
You are responsible for compliance with local laws. If your local law requires certain consumer protections that cannot be waived, those protections remain.
29. Notices and electronic communications
We may provide notices by email, in-product messages, or posting on the Site. Legal notices to us should be sent to legal@thecareerowl.ca and to:
CareerOwl Ltd., 735 Maple Drive, Quesnel, BC, V2J 5M9, Canada.
30. Assignment
You may not assign or transfer these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or to an affiliate.
31. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (for example: natural disasters, outages, supply failures, labour disputes, or government action).
32. Entire agreement; severability; no waiver; language
These Terms (plus the Privacy Policy, Cookie Policy, and any product-specific terms you accept) are the entire agreement. If any part is invalid, the rest remains effective. No waiver is effective unless in writing. If we publish translations, the English version controls.
Product-specific terms (if you use these features)
A. Sponsored jobs and pay-per-click ads
- Billing is based on our measurement of impressions, clicks, or apply-events.
- We may apply fraud filters and invalid-traffic rules.
- Placement uses dynamic signals like bid, relevance, quality, and user activity.
- We do not guarantee a specific rank, reach, or number of applications.
- You must not inflate metrics or incentivize clicks.
B. Resume search / candidate search
- Search results depend on profile completeness, relevance, recency, user preferences, and anti-spam safeguards.
- Do not download or store resumes at scale without written permission.
- Use candidate data only for hiring for the role in question; delete when no longer needed.
C. Company pages, ratings, and reviews (if enabled)
- Reviews reflect user opinions, not our views.
- We may moderate for policy-violating content, but we do not promise to review everything.
- Do not attempt to coerce positive reviews or suppress negative ones.
D. Employer of record / payroll (if offered)
- Any such services are subject to separate agreements and local law.
- You are responsible for your workplace compliance and safety obligations unless explicitly assumed in writing by us.
E. Background screening integrations
